Interesting Side-Step of Copyright; Also Porn
« on: June 19, 2010, 05:51 PM »
They side-step the copyright by titling it "This Ain't" Avatar XXX. The copyright holder cannot then claim that it uses the same title or that the title may cause confusion with the original work.

Porn films have been doing this for years. e.g. Flatliners >> Fatliners. They won't get sued. There's no cross-over competition in those markets, though the porn industry most certainly is riding off the coat tails of the non-porn industry. I do wonder though if someday they might be forced to pay licensing fees... The current tone of IP is seriously getting to be dangerous (there was a previous thread with something about fact "ownership"). I'd prefer to see porn free to do as it pleases without interference -- we really don't need more laws.

Parody may just be put in jeopardy though if things like this do get sued. (Family Guy has done Star Wars movies in their entirety.)

Anyways, for those that always wanted to see Smurfette do the nasty, this might just be the next best thing. :P

The adult film industry has always pushed the envelope when it has come to many areas. Many experts say the adult film industry was a major force in the adoption of VCRs in the home. The same is also said in regards to DVD players and the proliferation of the internet, especially high-speed access to the internet.

It doesn't surprise me at all if the adult film industry also pushes the envelope in the way everyone views copyright law.

This Ain't Avatar is nothing new. While adult parodies have been around forever, the "This Ain't..." series has been around a long time as well. Other "This Ain't..." titles:

This Ain't....

...Batman
...The Brady Bunch
...I Dream of Jeannie
...Three's Company
...Good Times
...Happy Days
...Charmed
...The Munsters
...Star Trek
...Gilligan's Island

Well, you get the idea....tons more I didn't even mention.

Hmmm... Do we have a challenger to dethrone Zane as the resident porn authority? ;) :P

Hmmmmm, for some reason "stretch the condom" comes to mind instead of "push the envelope."  But I was going to mention that at least up until now Parody and Satire were valid defenses against claims the work was a copy.

Tom Brokaw is retired but if Parody was no longer protection we'd lose other guys like John Stuart pretending to be newscasters.

One thing I can guarantee you - Hustler would absolutely *love* some sort of lawsuit trying to block the "It Ain't(tm) Avatar" movie.  You can buy that kind of advertising.

I must say though, I'm much more impressed by the punny titles that they often come up with for these movies:

  • A Bustfull of Dollars
  • Shaving Ryan's Privates
  • Star Whores
  • For Your Thighs Only
  • Lust in Space
  • A Star is Porn
  • Edward Penishands
  • Romancing the Bone
  • Pulp Friction

And Seattle had a peep show club that recently shut it doors that had an impressive marquee that would post things like:

  • Clash of the Tight Buns
  • The Skirt Locker
  • All Clothing 100% Off

It was fun to read the marquee, even if you would never think to go in.
