I have an ugly C# function I cobbled together... It's probably an excellent example of how not to deal with webservices in .NET, but I don't care much. :)

But no matter how you cut it, for every evil Microsoft has done, there's a greater evil in the Apple camp.

Just to pick one at random - Windows Media Player vs. iTunes when it comes to downloading/purchasing. At least MS had SDKs so anyone could play DRM'd music. With Apple, you've got Apple, Apple, or Apple.

We still need Linux to go more mainstream than it already it. It's progressed, but it still needs wider market penetration. That's going to be up to the hardware vendors. (And for companies like Dell to hone their negotiating skills.)

Anyways, I think we're going to be entering some very dark ages in computing now that will make us wish for the old Evil Microsoft, because it will pale in comparison to what's coming.

Got me thinking -- I'd like to know what kind of legislation people would be comfortable with.

To be honest, I think people need protection from the law now. Lawyers have run rampant for far too long, and have created a cluster-f**k of a system that ensures their jobs while also guaranteeing that everyone else gets screwed in the process.

Current contract law is probably best illustrated by South Park's Human CentiPad episode.

So it seems to me that it is the consumer that needs to be protected from lawyers/companies/the legal system.

I would like to see restrictions on what you can and cannot do in a contract or EULA. e.g. It should be illegal to allow an EULA to be arbitrarily changed and enforced for a software product (services are different, and that requires a different approach). Also, if you install ACME Proggie v10.2, you shouldn't have to read the EULA for v10.3.

This is particularly important for software like iTunes with a novel for an EULA as it is updated far too often for anyone to reasonably be expected to read its EULA.

Then there is Acrobat Reader that has daily updates along with Java and it's 3x daily updates...

If you were to read the EULA, you would do nothing but read EULAs all day long. It's insanity.

Like JFC... I have to agree to the "terms and conditions" just to walk in a f**king store or park my car... it's way out of control.

Things I would want to see:

  • Changelogs for EULAs - Let people know what has changed so they don't need to read another novel
  • EULAs skipped for software updates with no EULA changes - labeled as such
  • No "we can change the EULA at any time" for software (not services)
  • No passive consent to be considered consent - This has serious implications for web sites
  • EULAs longer than a page or so to have "common sense" summaries
  • Proprietary EULAs, e.g. not GPL, BSD, Apache, Ms-PL, Creative Commons, etc., to have upfront list of implications for non-standard terms/conditions
  • Reasonable limits on who is required to comply - i.e. This is not important for small companies, e.g. under $10 million in revenue

A few other things as well I suppose.

Basically, I want to see companies write EULAs in good faith, and provide software in good faith. This is becoming an increasingly larger problem with companies like Apple changing the game mid-way through.

I am NOT for additional legislation or regulation. I abhor more laws/regulation, but I think they are now needed as we are seeing more and more bad faith. Laws are needed to keep bad people in line.

Am I out in left field?

You should watch the South Park season 15 premiere episode entitled: "Human CentiPad". It is a showcase of what could happen if you fail to read the EULA.

I have my own share of anger at Microsoft for lots of things they do that I'm not happy with.

But I honestly wonder if in 10 or 20 years we are going to look back at the times we are living in now and lament the death of microsoft and the death of the good old days when software companies actually made products and sold those products to users.

Seems like we are headed into an age where companies are going to be trying to find increasingly convoluted and complicated schemes to extract money from us without actually charging us directly for the products we use.  And I'm not looking forward to it.

MS can certainly drive me into a screaming frenzy at times, but man... Look at the alternatives!

MS has a long history of bringing people along to make money with them. I'm afraid that the environment for independent, small developers will become increasingly hostile.

The normal EULA in the shareware/trialware/try-before-you-buy world is going to be slowly subverted with increasingly complex clauses and whatnot.

I for one would LOVE to see legislation that made it illegal to change an EULA for existing users, and regulation that forced companies to ONLY display an EULA for an upgrade IFF there were changes in it, AND to make those changes visible UP FRONT. i.e. Make a changelog mandatory. Well, at least for companies with revenues over some sane number, like $10 million or so.

I'll keep my opinion on Apple to myself rather than spew venom.

However, I will make a note that similar tactics have been used for a long time by large companies to drive smaller companies out of business.

Here's the Modus Operandi:

  • Create big store
  • Sell "bread and butter" products below what small stores can afford
  • Wait for small stores to close

Small stores used to carry specialty items to keep customers happy and coming back. That doesn't happen anymore. You can't buy specialty items at retail now. You get $0.50 products for $12.95 instead, because there's nobody that can compete anymore. If you want a specialty item, well, get it online or don't get it because there are no stores anymore that serve customers. And no... I don't believe that a greeter or a forced smile is a substitute for competence.

Apple is doing the same thing -- making it impossible for anyone to do business except for them.

Yay. Capitalism at work. Making the markets "more efficient" because that's "good for consumers"...
