On another level, the article doesn't seem to make sense. The defendant is accused of offering songs for download. Yet he's not being sued by the RIAA -- he's being sued by the MPAA. In other words, it's not the music industry that's suing him for music, it's the movie industry that's suing him for music.

I just commented on this in the previous post - I had missed this part of a post altogether.  But it IS a valid question.

First, if the story is accurate at all this is a disgrace.  Some here say it is misreported - I don't know how that was determined.

But my big question is.......

Why is the MPAA going after a person for downloading "songs"??  I thought the RIAA did that and the MPAA went after movie downloaders.  Weird!

I saw that email from Gates yesterday morning - thought sure it had to be a spoof so I "googled" it and.... Oh my!  It's real!

Fantastic!  That was released by the court so I imagine MS never expected it to get out to the public.

If you locate and download the PDF of the entire exchange, it has five or six emails after that where the various MS dept. heads are bouncing this around like a hot potato, trying to pin the responsibility for fixing it on each other.  And their grammar and spelling are a complete disgrace, too.

...Right.  I'm not arguing in favor of DRM or any other lame (nuisance) device.  A point here is that it was the very pirating of products that fomented the DRM and their ilk in the first place.

But you are arguing in favor of DRM! Stop and read your own posts here.

And are you certain that pirating fomented DRM?  Methinks not!  The root cause was the fact that the recording industry was woefully unprepared for the digital availability of media files. Once again, they continued their long-standing history of not looking past the end of their last counted dollar and suddenly realized that their products could be made available on the Internet.  They could - and should - have reacted in their common capitalistic way and developed a method by which they made their media products available to the online community in a way that is beneficial to all.  They have ALL the songs, ALL the movies, in their arsenal and could have put it up for a fair price, and in an extremely convenient way for this new brand of consumers to purchase them.  Following "fair use" concepts at the same time.

Instead their gut reaction was, "STOP THAT!!!"  And what did they spend a fortune doing?  Developing more and more DRM methods, contracting with hackers to hack the servers of those sharing the media files (That's for real! They were caught doing exactly that!), and then filing lawsuits against every person they could find that they even remotely suspected was sharing media files online!

Of course Apple simply opened shop with iTunes and showed them one way to do it right.

No, I disagree, CodeTrucker...  'twas pure, unadulterated greed that fomented DRM, and thus large-scale pirating of their precious cargo.

More seriously, though, the recording industry has done more to popularize the pirates than anything else.  Their well-publicized scatter-shot lawsuits against all - but especially children and the proverbial "little old ladies" - has garnered more sympathy for illegal downloaders of music/movies in so-called "normal", non-geek/hacker communities than they could ever have imagined.  While it is meant to instill abject fear in anyone considering downloading illegally shared media files, it has also given pirates a kind of "Robin Hood" status for many, no matter how undeserving a title that may be.

Bottom line, IMO:  These companies had a sure-thing "golden goose" handed to them out of the blue when they discovered early on that folks could obtain digital media files online.  And they reacted in a way that is all-too-common for them...  They immediately grabbed ahold of the goose, strangled the goose, and then started trying to crap out the golden eggs themselves.  Of course when they reached behind them,  their hands came back full of..., well, you get the picture!    :o :huh:    :Thmbsup:

I don't think you'll find anyone here, Zane, that disagrees with you. I don't believe that I have ever seen anyone here at DC offer arguments FOR DRM!  (Different from arguments against outright pirating: making many copies and selling them).  I have probably as much rip/copy software as anyone here, and yet I still have a WMV that I paid $30 for and after reinstalling my OS the password/key for it is no longer working. (Really pisses me off).  I contacted the vendor - a known, "real" vendor, not a private party or fly-by-night operation - and have never gotten a response.  Digging deep on their website I found a paragraph stating that when this happens I have to remove WMP 10 or 11 and install WMP 9 - one specific build - and then contact them for re-activation.  That's a bunch of BS!

Over the past, say, 35 to 40 years I have re-purchased the same music at least 4 times over again:  That's a small fortune in music on vinyl, then as 8-track tape cartridges, then cassettes, and now I have purchased some of the same stuff yet again on CD's.  It will never, ever end  They want our money for the same products every 3 to 6 years.  And the RIAA and MPAA are keeping a lot of cretins - err... - lawyers - wealthy doing this every day.  I have been sick of it for a lot longer than the current "DRM" label has been assigned to this scam.

Personally I fully support any and all efforts to bypass whatever DRM protection is applied to recorded media.  Not doing it for sales profits, but for personal or family unit usage. Without even a tiny a twinge of guilt.

No thanks, Perry.  I have Nuance's PDF Converter Professional 5 installed, and that is pretty extensive but has a lot of hooks into the OS.  Having too many PDF programs might get a little "conflicting"!!  ;D  (Besides, I also have had the Cute PDF driver installed for a while - very nice free PDF creator!)

Agreed - this is simply a cut-back version of one of their past burning program releases.  Still decent, but a little deceptive.  It appears they are just looking to build their email marketing list.  The disposable email address I used to download this received three "offers" from Ashampoo in the first two days.

I agree whole-heartedly with 40hz in that if you can afford it at all, support any freeware developers whose software you use regularly.  I always do; always have.  I understand that I have been very fortunate to be able to donate, and that some cannot do so.  Well, they cannot do so at least for a time. But everyone usually has good periods when they have a regular income; hopefully most are fair about donating.

What I imagine can get very frustrating for developers of free application is that a lot of folks demand that their software stay free, and further demand that they constantly work on bug fixes and adding the features they want.  I mean, greedy to a very large fault!  If you don't think it is that tough, take a look over at LifeHacker or even "Give Away Of The Day"!  GAOTD had a media file converter available today and you have to read the comments there - apparently the software does not yet support Vista. The user comments there are extremely bitter because of that, even though the developer posted that Vista support would be available shortly. You would think this company was run by serial killers or something from the user reactions!  "Rotten", "cheating", "idiot" are just some of the terms used.  Hey, if they really want everything exactly as they like it they could purchase any number of converters that are out there on the commercial market!  But they would rather hurl hateful crap at that developer.

And at LifeHacker whenever they run a poll of the Five Best {Name the utility app here}, free programs are always the overwhelming choices for the top spots.  As if "Free" must equal "Best" rather than "What I want". Some commenters at LifeHacker have actually "scolded" Gina Trapiani there for daring to post reviews of "PAY" applications.

If I were a developer of freeware, it wouldn't take a whole lot of that kind of "respect" by the users to convince me to go commercial!

Arrgghh -- They still have  rotten bookmark organization, IMO.  Glad I got Linkman after all (even though after my purchase they never answered any support requests).

Firefox still does not have any way to find a bookmark that you saved.  Oh, you can search in the "Organize Bookmarks" section, and it will find it.  But there is NO way I can find to see where the bookmark actually IS.  I have a lot of folders/subfolders in my FF bookmarks, and occasionally I save a bookmark and then have no idea which folder/subfolder it is in.  So in order to use the bookmark I must open "Organize Bookmarks" and launch the page from the search result.  It does not say WHERE the bookmark is located, so the only way to get it to a folder, say, on the Bookmark Toolbar you must save it again to there.  I get way too many duplicates that way.

I just installed it yesterday.  Very fast, and the leaner memory hit is amazing!

Can't say as much about the new default theme, though.  I am not that much into skinning - why use up this newly freed memory with graphics?  But the new look is pretty bland. And there are not that many add-on skins available for it yet.  Be a while for that, I guess.

Also, about half my extensions worked right off the bat.  I do have the Nightly Tool Tester extension installed, which can "force" a compatibility update for non-working extensions.  But it will only work, of course, if the core extension CAN work in the new version.  If not, the browser can get pretty broken.  So I am trying to determine that others have successfully gotten the extension to work elsewhere before I just dive in and do it myself.  So far about a quarter of my favored extensions are still not working.

I had already seen that browser speed test at LifeHacker.  Though it is difficult to compare browsers, the tester did a pretty thorough job, actually.  Did about as much as he could to "normalize" the test across all tested browsers.  Plus, his results pretty much mirror my experience!  (Which is subjective, as is everyone's here on browser speed!)

Actually he gave Firefox a big break by using a "clean" version without any extensions.  And not many users have zero extensions installed!

Just upgraded from Opera 9.27 to 9.5.  Crashed about 5 minutes after starting up the new version.  Restarted it but now it crashes before it even loads! As soon as I click on the icon the Windows dialog announcing "Opera Internet Browser has encountered a problem and needs to close." appears.  Opera 9.5 never does get loaded now.

Any ideas?  (This has never happened to me with Opera before).

Simple supply and demand answer.  When you "save" enrgy consistently, power companies stop generating as much!  No, they cannot reasonable store the unused power they have already generated.  But they CAN store the fuel (whichever type they are using) that they do not use when they generate less power because the demand is lower.

Personally, I think the biggest hit - not counting rich multimedia files - is the visuals.  The "skinning" of many, if not most, applications today seems to take an inordinate amount of memory.  High-end graphics cards with massive gpu's gobble up memory and CPU.  As the technology allows, many developers skin their programs with graphics that take time to render.  Some developers - and I won't get into THAT bitch session now - add a lot of graphics rather than features to the applications.  They figure that if they make it visually stunning a lot of users will be impressed.  And it is much cheaper and easier for them that adding features/functionality.  How many programs are you running where their last so-called "major" version upgrade consisted mainly of Vista compatibility and changing the look to a "ribbon"-like format?  (One well-known mind-mapping developer did exactly that - and hardly any new features - in their last upgrade.  I read later that to keep their Microsoft Logo Certificate they were actually required to move to a ribbon UI!)  And while MS Office 2007 did introduce Microsoft's revolutionary new standard file formats  (cough, cough), what was the single biggest change?  The UI.  Check and see how much more memory Office 2007 takes to run than Office 2003 and then decide whether or not any added feautures are worth the hit.

Ouch!  Anything that installs an unwanted toolbar is dealing in malware, IMO.  Unless of course the toolbar belongs specifically to that application and can be disabled.  (E.g., Linkman has an IE toolbar for bookmarking.)

Some free programs extract an unmentioned price like that!

AFAIK, they just modify the INF files to include more machines in the allowable install file. They also seem to have an active forum to help people.

Nvidia's forum may be active, but users only - you won't see Nvidia representatives there helping out much.

Also, Nvidia will NOT offer any support if your graphics card came pre-installed in your computer.  When you go to their support page the first thing you encounter is a question asking you to check off which situation fits:  directly purchased and installed your Nvidia card, or the card came pre-installed in your computer.  If the second case is true they say they're sorry but you must contact your computer manufacturer for support.  They will only support direct purchases.  Believe me, I have tried several times to get help from them!

Also, I haven't seen what sound card the OP has.  The problem could actually be a conflict between the new Nvidia driver and the sound card driver.  Often happens with Nvidia graphics cards and Creative SB sound cards.

I don't know, kartal; that's looking at two separate items on the site.  I would imagine that we won't know for sure what the limits will be on the free accounts after the beta is over.
Right now, though, it looks pretty good.

I'm looking for something for online storage.  I have been using Mozy for online backups for a little over a year now, but ever since they released version 1.8.8.x it is extremely difficult to maintain a connection with Mozy.  Thought it was my own setup, and Mozy support naturally points to that also.  But recently I am seeing a lot of users - mostly bloggers - complaining about the same problems.

I just requested a refund of my year's renewal I paid last month and they are trying to talk me out of it.  But unless they can fix the client application or their server issues, whichever is screwing up, it is difficult for them to talk one out of leaving!

Just to be realistic, I don't think there is a chance in hell we will make this list.
I think the real goal is just to try to make some little progress towards getting PC Magazine to realize we exist.  Every little bit helps.

Now there's an example of positive thinking if I ever saw one!
