Think of it as quitting while you're ahead, or nipping something in the bud. They've seen what a total disaster the US has made of SW patents...so they simply avoid that level of mess by learning from the mistakes of another.

Where are you finding 5300rpm SATA drives? My WD3200YS RE drives are 7200rpm, and I generally always went for the lower speed drives because I assumed (as you mention) that they'd last longer. Even the Nearlines I used for the storage array of the new server are 7200rpm.
