Attorneys Warn of Increased Risk of Big Data Breach Lawsuits
Two attorneys for a prominent law firm warn that courts are starting to look more favorably on class-action lawsuits brought by data breach victims, who historically have had trouble proving actual damages from the thefts.

Hmm..."Two attorneys for a prominent law firm" I see.  :-\

Not exactly the most disinterested of parties to be sounding the alarm are they? ;D

Seems more like the Second Law of Thermodynamics to me. Not that it really matters. The outcome is the much the same either way.

Well, I can't completely say it is a bad thing. A lot of companies have shown the reaction of "Sorry too bad." when that kind of thing happens.

If this actually does get pursued, it has a good chance of putting some pressure on companies to actually care about such mishaps and taking better measures to prevent or correct them.

^It would be even better if regulatory agencies stopped allowing companies to get off with paying a fine but not admitting to wrongdoing. That's the loophole that makes half of the nonsense out there possible.

I run a company too. LLC mind you, but still a valid legally-recognized company.

It's the big brothers that don't care, most of the little guys do because their reputations are at stake.

Well, if the gov't won't take actions to stop these companies that horde our personal data in substandard, unsafe way, then I'm glad someone is attempting to hold them accountable.  Seems they want it both ways, they want all of our personal info AND don't want to be held accountable for their handling/storage of this data.  I say if they have to pay through the nose every time their lax security allows a data breach, then they will start taking better care of our information.

Oh, c'mon now 40!~ You know that's not what I meant. I wasn't talking about caring about profit! :P ;D <ducks>Just kidding!</ducks>

Yep. That's it. :)

I meant "company" purely in the pejorative sense. :P ;D

Speaking of...

http://www.globalresearch.ca/america-vs-bank-of-america-lawsuit-spectacularly-brazen-fraud-no-criminal-charges/5309945

Quote
But the record speaks for itself. Not a single high-level banker has been prosecuted, let alone jailed, since the Wall Street crash of September 2008. Not one major civil case has actually been brought to trial. Instead, the government has allowed the culprit banks to work out settlements in which they paid token fines and admitted no wrongdoing.

The former head of Countrywide, Anthony Mozilo, was let off by the Securities and Exchange Commission with a fine of $67.5 million and no admission of guilt in October of 2010. The following year, the Justice Department quietly dropped its criminal probe of Mozilo.

Last month, Bank of America agreed to pay $2.48 billion to settle claims it misled investors about its acquisition of Merrill Lynch at the height of the financial crisis in late 2008. In February of this year, the government allowed the bank to settle fraud allegations involving Federal Housing Administration loans for $1 billion, also without admitting wrongdoing.

Just another day...

If the same standards applied to us, we could run around robbing and killing people, then just pay a fine.

Why is the theme music to "The Twilight Zone" running through my head?

So, please won't somebody tell these lawyers to force my bank to ALLOW SPECIAL CHARACTERS in our login passwords...

(true story, my bank only allows numerals and uppper/lowercase letters  :-\ )

I know of one that allows only digits. Could be worse. :D (But not much!)
