Ugh, so I see. I've been seeing quite a few things about that same problem when searching google. I'll see what I can do, and at least get rid of that ugly dialog.

Doing some really odd stuff.
Can create two folders with the same name

Also, within a folder group called MASTER:
I had one folder, called ONE
with sub-folder SUB-ONE
Then I dragged another folder SUB-TWO into folder ONE
So I had
    MASTER
         ONE
           SUB-ONE
         TWO
           SUB-TWO
Restarted Auspex
Now have two sub-folders with the same name
    MASTER
         ONE
           SUB-ONE
         ONE
           SUB-TWO

(and the other in a bowl of marbles)
